Fair Housing & Compliance When Using AI

AI-generated marketing, chatbots, screening tools, and ad targeting can violate fair-housing law without anyone intending to. This course shows where that exposure comes from and the practical steps that keep a brokerage protected. You'll learn to review AI content before it runs, test your own tools for fairness, and keep a compliance file that stands up to scrutiny. You'll finish with a one-page fair-housing AI checklist for daily use.

Course Description

Fair-housing obligations don't change when a tool writes the ad, answers the inquiry, or scores the applicant. The output is still the brokerage's own statement and decision. This course applies fair-housing principles to AI in working, practical terms.

What you'll learn

  • Fair-housing fundamentals, and the new exposure points AI creates
  • Disparate impact at a working level, and how neutral inputs can act as proxies
  • Advertising rules for AI-generated text, images, and ad targeting
  • Reviewing marketing before it runs, and configuring chatbots that don't steer
  • Fair screening, accommodation requests, and accessibility
  • Training the office, testing your own outputs, keeping a compliance file, and handling a complaint

Who it's for

Answers to the most common questions about this course.

What is the Fair Housing & Compliance When Using AI course?
Fair Housing & Compliance When Using AI is a RiseCert online course that teaches real estate professionals how AI-generated marketing, ad targeting, chatbots, and tenant-screening tools can violate fair housing law, and the practical steps that keep a brokerage protected. It includes 15 video lessons (about 1.5 hours) and a final exam.
Who should take an AI fair housing compliance course?
Real estate brokers, agents, team leads, property managers, leasing staff, and compliance officers who use or supervise AI tools for listings, advertising, lead response, or tenant screening. Marketing coordinators and assistants who draft listing descriptions or ads with AI also benefit, because they are often the first to publish AI-generated content.
Can AI-generated real estate ads violate the Fair Housing Act?
Yes. The federal Fair Housing Act prohibits discriminatory housing advertising whether a person or an AI tool wrote it. AI-generated copy can include people-focused or coded language, AI-selected images can imply who belongs in a home, and ad-targeting settings can exclude protected groups. The brokerage is responsible for everything it publishes.
What is disparate impact, and how does it apply to AI in real estate?
Disparate impact means a policy or tool that looks neutral can still create fair housing liability if it disproportionately harms people with a protected characteristic without a sound justification. In real estate, AI screening scores, ad-delivery algorithms, and inputs like ZIP code can act as proxies for protected characteristics. The course teaches a four-question test for any tool or rule.
Which protected characteristics does fair housing law cover?
The federal Fair Housing Act protects seven characteristics: race, color, religion, national origin, sex, familial status, and disability. Many states and cities add more, such as source of income, age, marital status, or military status. The course covers these protections in general terms, is not state-specific, and shows how to account for the local additions where you work.
Do I need AI, technical, or prior fair housing training to take the course?
No. The course is written for real estate professionals, not technologists, and explains every concept in plain language with real estate examples. Prior fair housing training helps but isn't required: the first lesson refreshes the fundamentals, including protected characteristics, steering, and discriminatory advertising.
How is this different from a standard fair housing course?
Standard fair housing courses cover the law and how people violate it. This course focuses on the new exposure AI creates, including generated ad copy, AI-selected images, ad targeting, chatbots, and screening algorithms, and on the review, testing, and documentation practices a brokerage uses to prevent violations and prove compliance.
What will I be able to do after completing the course?
You'll be able to review AI marketing before it runs, catch coded and people-focused language, configure a property chatbot that doesn't steer, apply tenant-screening criteria consistently, handle reasonable accommodation requests, test your own tools for fairness, keep a compliance file, and respond correctly to a complaint. You'll leave with a one-page fair housing AI checklist.
Which AI tools does the course cover?
The course is vendor-neutral. It covers the categories of AI tools brokerages actually use: AI writing assistants, image generation and virtual staging, social media and digital ad targeting, website and text chatbots, lead-response assistants, and tenant-screening or scoring tools. No specific product is required or endorsed.
Does the course cover AI tenant screening and property management?
Yes. Dedicated lessons cover AI tenant screening and placement, including applying written criteria equally and treating a tool's score as an input rather than a decision, and handling reasonable accommodation and modification requests that automated systems often mishandle. The marketing and advertising lessons apply to rentals as well as sales.
Is the course content up to date?
Yes. The course reflects fair housing enforcement attention on AI as of September 2026, including a dedicated lesson on where regulators are focusing. Because rules in this area are still evolving, it emphasizes durable practices, such as pre-publication review, testing, and documentation, that hold up as guidance changes.
How long does the course take to complete?
The course has about 1.5 hours of video across 15 lessons, plus a final exam. Lessons run five to seven minutes and are organized into three modules: The Law, Applied to AI; Practices; and Protection. It's easy to complete in a few sittings.
Is the course online and self-paced?
Yes. The course is 100% online and self-paced, and your access does not expire. You can start, pause, and resume at any time on a computer, tablet, or phone with a modern web browser. There's nothing to install.
Is there a final exam?
Yes. The course ends with a 30-question multiple-choice final exam covering all three modules. You need a score of 80% or higher (24 of 30) to pass, and you can retake the exam as many times as you need. Finish all 15 lessons and pass the exam to complete the course and earn your certificate.
Do I get a certificate of completion?
Yes. After you complete all 15 lessons and pass the final exam, you can download a RiseCert certificate of completion from your account. It is a course completion certificate, not a state license credential or a continuing education (CE) certificate.
Does this course count for real estate continuing education (CE) credit?
No. The course is not currently approved for real estate continuing education credit in any state. For license-renewal CE hours, take a course approved by your state real estate commission or regulator. This course is designed to complement required CE with AI-specific compliance practices, not replace it.
Does it meet the NAR fair housing training requirement?
Not confirmed. The National Association of REALTORS® requires members to complete periodic fair housing training, and local REALTOR® associations decide which courses qualify. If you're enrolling to meet that requirement, confirm with your local association before you buy.
Is this course legal advice?
No. The course is educational and is not legal advice. It teaches practices that reduce fair housing risk when using AI, but it can't guarantee compliance. For questions about a specific situation, tool, or complaint, consult a qualified attorney in your jurisdiction.
How much does the course cost, and can I enroll my team?
The course costs $99 per learner as a one-time purchase, with no subscription or recurring fees. To enroll a team or brokerage, contact RiseCert through the Contact Us page at risecert.org.
What is the refund policy?
All sales are final and no refunds are issued, as stated in the RiseCert Terms of Use. Please review the course description, lesson list, and these FAQs before purchasing, and contact us with any questions first.
